What Is Different About A Military Divorce?

Military divorces raise many unique questions and concerns. Is the nonmilitary spouse entitled to a portion of the service member’s pension? Can a divorce proceed if one spouse is deployed overseas? What will happen with child custody? What about other benefits such as Tri-Care?

At Rowe Law Offices, P.C., we are here to answer your questions. We have represented many military service members and their spouses in divorces, asset division disputes, child custody concerns, child or spousal support issues and related matters.

Because we recognize the sacrifices of service members and their families, we discount our fees by 10 percent for divorces and all legal matters involving military members and their families. Many of us here at Rowe Law Offices, P.C., have family members actively deployed or otherwise serving in the military.

Dividing Military Pensions In Divorce

Many attorneys are reluctant to deal with the division of military pensions and benefits because of the inherent complexity of these cases. Working in conjunction with the Judge Advocate General’s Corps (JAG) when necessary, we can draft qualified domestic relations orders (QDROs) to fairly divide pensions. Many factors come into play when dividing these assets, including the length of military service, the length of the marriage and other considerations. We also work with Domestic Relations to implement some types of support orders
