Legal representation during same-sex divorce

On May 20, 2014, same-sex marriage became legal in Pennsylvania. As a result, the attorneys at Rowe Law Offices P.C. are now able to handle a range of LGBT legal issues such as same-sex divorce. Whether you were married in Pennsylvania or in another state, we are prepared to help you finalize your divorce in Pennsylvania. Our Berks County attorneys have experience helping to represent LGBT clients who are going through a same-sex divorce.

Clients often wonder how long their same-sex divorce will take to finalize. The factors that determine how long a same-sex divorce will take to complete are the same factors that people going through heterosexual divorces face. If both partners agree to the divorce and there are no disputes over marital property or child custody issues, the divorce could become final 90 days after the date of separation. When there are disagreements over any of these issues, however, the divorce process may take much longer.

Our lawyers are prepared to help you to finalize an uncontested or contested same-sex divorce as fairly and efficiently as possible. If your ex-partner is not in agreement about the divorce, we may be able to help you to obtain a divorce on fault grounds, which can be completed in some cases after 90 days from the date of separation. An individual who has been separated from their spouse for some time may prefer to file for a no-fault divorce after waiting two years after the date of separation.

Because the same laws apply to same-sex divorces that apply to heterosexual divorces, one ex-spouse could be ordered to pay alimony to the other ex-spouse. You can learn more about alimony, property division and other issues by visiting our page on same-sex divorce.
