Many people in Berks County are aware that Hollywood marriages don’t often last. Even some of the longest-lasting marriages, like that of David Cassidy and his wife run the risk of ending in divorce. In fact, after 23 years of marriage and 5 more years of dating, the Cassidys have filed for divorce. How the former “The Partridge Family” teen heartthrob is taking the split remains to be seen, but his soon-to-be ex-wife has said that she is happy Cassidy is getting help for his alcohol addiction.
Though the media has not yet reported on it, how the couple plans to split their estate will likely be a focus of attention in the coming months. Neither spouse will be getting child custody or child support awards, as their only son is an adult. This does not mean, however, that Cassidy’s wife couldn’t ask for alimony.
Ultimately, the first question the spouses’ family law attorneys will ask is whether there is a prenuptial agreement governing their marriage. If there is, the divorce settlement will likely mirror the agreement. If not, however, the court will likely look to a variety of factors in determining if the wife is eligible for alimony.
First and foremost, the court will take into account the earning disparity between the two spouses. Though Cassidy has not been acting or singing as much recently, he is likely to have much greater earning potential than his wife. The court will also look to the length of the marriage, among other factors.
Whether someone is eligible for alimony in Pennsylvania requires a similar approach and one that can best be explained by a family law attorney.
