Skilled Assistance With Same-Sex Divorces
In the past, same-sex couples who legally married in other states did not have the option of obtaining a divorce in Pennsylvania. This is no longer the case, as same-sex marriage became legal in Pennsylvania on May 20, 2014.
At Rowe Law Offices, P.C., our attorneys understand the issues that LGBT couples have traditionally faced in Pennsylvania. We also understand your remedies under the current law. We offer a free initial consultation to discuss your case. Our same-sex divorce lawyers represent LGBT couples who were married in Pennsylvania or in other states such as Massachusetts.
Can I Get Divorced In Pennsylvania If I Was Married In Another State?
Yes, if you were married in a state that recognizes same-sex marriage, you can get divorced in Pennsylvania.
How Long Does It Take To Get Divorced?
If you and your partner agree to the divorce, you can obtain a final divorce 90 days from your separation date. Your separation date is the date that you and your spouse begin to live as two separate people.
If your partner does not agree to the divorce, you have two options:
- You can obtain a no-fault divorce after waiting two years from your separation date.
- You can obtain a divorce in 90 days if you file for divorce on a fault ground.
Will I Have To Pay Alimony And Divide Marital Property?
You have the same obligation to divide marital assets and debts as a heterosexual couple who divorces. Pennsylvania could also order alimony payments depending on factors such as the length of your marriage and your financial circumstances.
The same laws that apply to heterosexual divorce apply to same-sex divorce. For more information about your rights and obligations, visit our Divorce page.
